O Ativismo Judicial preconiza a concretização dos direitos fundamentais sociais garantidos pela Constituição Federal através do Judiciário diante da inércia dos poderes Executivo e Legislativo.
Em resumo, ações que deveriam ser tomadas pelos outros dois poderes acabam sendo abarcadas pelo Poder Judiciário, em decorrência da falta de ações a serem exercidas pelo poder específico.
Assim, aquele que deveria ser o maior garantidor da efetividade dos direitos sociais da população, dentro de suas responsabilidades determinadas, não o fazem e, em consequência, os cidadãos acabam por enfrentar diversas dificuldades, sobretudo com relação ao direito à saúde, como a falta de médicos, hospitais e remédios.
Diariamente há violação desse direito fundamental e, com isso, surge a necessidade do Judiciário intervir buscando garantir o acesso da população a esse direito tão indispensável à vida e dignidade da pessoa humana.
Entretanto, essa atuação gera várias polêmicas, uma delas é se o Judiciário estaria desequilibrando a ordem natural dos três poderes.
Entendemos, no entanto, que não, pois, apesar de dar a impressão de que existiria uma usurpação dos poderes, não é o que a definição conceitual nos traz, pois, a ideia é a de que, na ausência de uma previsão ou ação que garanta a efetividade da norma jurídica, no caso a CF e o direito fundamental à saúde, o Judiciário possa exercer seu papel e efetivar o acesso à satisfação de uma necessidade do cidadão.
Portanto, nosso entendimento é o de que, desde que respeitados os limites do bom senso e razoabilidade, deve o Judiciário, na ausência de políticas que o façam, garantir à população o acesso a um dos direitos mais fundamentais que devem ser garantidos e ofertados à população, o direito à saúde.
